Reach3 Insights CES 2019 Chat Contest (the “Contest”)
This Contest is held and administered by Reach3 Insights Inc. (the “Sponsor”). It runs from January 9, 2019 to January 21, 2019 (the “Contest Period”) in accordance with these Official Rules. No purchase is necessary to enter or win. A purchase does not increase the chances of winning.
The Contest is open to only legal residents of the United States (including Washington DC and excluding Puerto Rico) who are thirteen (13) years or older as of the first day of the Contest Period and, if under 18 years of age have obtained a parent’s or legal guardian’s prior permission. Minors who enter must have written consent of a parent or legal guardian in order to be eligible to receive any prizes. Employees of the Sponsor or other companies associated with the promotion of the Contest, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies, as well as immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. This Contest is void in all U.S. Territories, all foreign territories not specifically included herein, and where prohibited or restricted by law and subject to federal, provincial and local laws and regulations.
- Agreement to Official Rules
Participation in this Contest constitutes the entrants full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent on being compliant with these Official Rules and fulfilling all requirements so forth herein. Entrants further agree that these Official Rules will be construed and evaluated according to the laws of Canada and the Province of British Columbia.
This Contest is Sponsored by Reach3 Insights Inc., of 20 W Kinzie St. Chicago, Illinois and Administered by Rival Technologies Inc. of 1199 West Hastings Street, Vancouver, BC. Any and all advertisers, persons or entities in any way associated with this Contest, including but not limited to Consumer Technology Association (CTA), Google LLC, Facebook Inc., Twitter Inc, Snap Inc, and any and all of its subsidiaries and affiliates, are not endorsing sponsoring, or otherwise affiliated with this Contest in any manner whatsoever. Consumer Technology Association (CTA), Google LLC, Facebook Inc., Twitter Inc, Snap Inc, and any and all of its subsidiaries and affiliates, are each completely released of all liability by each entrant and participant in this Contest.
- Contest Period
This Contest beings at January 9, 2019 and ends on January 21, 2019. Entries that are submitted before or after the Contest Period will be disqualified and ineligible.
- How to Enter
No purchase is necessary or required to enter the Contest. A purchase does not increase an entrant’s chances of winning.
The method of entry to participate in this Contest, entrants must:
- Have a valid mobile phone number; and
- Click on the Sponsor’s promotion of the Contest as published and/or promoted on Facebook, Instagram, Twitter, Snapchat, or SMS, after which the entrant will be directed to the Contest where the entrant will be required to (i) confirm that the entrant has read, understood and agreed to abide by the Contest’s Official Rules; (ii) provide basic personal information, including but not limited to, the entrant’s age, gender and area of legal residence; (iii) provide an active personal email address; (iv) follow the instructions and complete the online survey
For greater clarity, the Sponsor reserves the right, in its sole and absolute discretion, to disqualify any Entry that the Sponsor deems is not compliant to the Contest Specifications and/or these Official Rules of this Contest.
Limit of one (1) Entry per Contest Period (i) per person (regardless of the number of email addresses or mobile phone numbers), or (ii) per email address (regardless of whether more than one person uses the same email address). For greater clarity, and for the avoidance of doubt, should the Sponsor discover that an entrant has entered the Contest on more than one occasion during the Contest Period, all further Entries, save for the first Entry, shall be disqualified and shall not be eligible.
The winner of the Contest (the “Winner”) will be awarded their choice of one (1) of the following prizes
- One (1) Google Home Hub (Subject to the Winner’s legal residence, this prize has an approximate retail value of $99.99 US Dollars)
- One (1) professional research survey administered by Reach3 Insights (Subject to the Winner’s legal residence, this prize has an approximate retail value of $5000.00 US Dollars)
- Winner will provide list of key research topics, from which Reach3 will develop one (1) chat survey not to exceed 5 minutes in length
- Reach3 will manage programming the chat survey and will deliver a live link that the Winner can then distribute through any means they see fit for a fieldwork period of 3-5 days
- Winner will be responsible for providing needed sample, email list, or delivery method that the chat survey will be sent to
- Winner will be responsible for obtaining any and all permission needed to contact the sample list that they send the live link to
- Upon completion of the chat survey fieldwork, Reach3 will provide the Winner with one (1) set of formatted data tables in Excel format displaying the results of their chat survey data within 10 days of the completion of fieldwork.
The specifics of all the aforementioned elements of the prize are solely determined by the Sponsor. No cash or prize substitution shall be permitted except at the Sponsor’s sole discretion.
All costs, taxes, fees, and expenses associated with any element of the prize not specifically addressed above are the sole responsibility of the Winner. All federal, provincial, state and local taxes on the prize are the Winner’s sole responsibility.
The odds of winning depend on the number of eligible Entries received.
- Winner Selection and Notification
The potential Winner will be selected in a random drawing from all eligible Entries by the Sponsor on January 28, 2019.
The Sponsor shall contact the potential Winner by email within twenty-four (24) hours following selection of the potential Winner. To be declared Winner and claim the prize, the potential Winner must:
- Sign an Declaration and Release form. The Declaration and Release requires the potential Winner to confirm, in writing, except where prohibited by law, acceptance of the prize as awarded, eligibility to participate in the Contest and compliance with these Official Rules and to release the Sponsor, and any third parties including but not limited to Consumer Technology Association (CTA), Google LLC, Facebook Inc., Twitter Inc, Snap Inc, their parents, affiliates, subsidiaries, divisions, their advertising and promotional agency, sponsors, suppliers of prizes, materials or services related to this Contest, and all of their respective employees, directors, officers, shareholders, agents, successors and assigns (the “Released Parties”) from any and all liability and damage which could arise out of or in any way related to the Contest and from the awarding, receipt, possession and/or misuse of the prize.
The potential Winner will be required to return the Declaration and Release form, properly executed within twenty-four (24) hours of issuance of the potential Winner notification. Upon successful completion of the above, which is at the sole discretion of the Sponsor, the potential Winner will be declared the Winner and thereafter be entitled to the prize to be delivered in a matter at the sole discretion of the Sponsor.
The Sponsor shall have no liability for the potential Winner’s failure to receive notices due to spam, junk email or other security settings or for the potential Winner’s provision of incorrect or otherwise non-functioning contact information.
If the potential Winner cannot be contacted, is ineligible, fails to claim the prize within twenty-four (24) hours from the issuance of the potential Winner notification, incorrectly answers the mathematical skill-testing problem, or fails to timely return a completed and executed Declaration and Release form (in the form and format provided by the Sponsor), the potential Winner’s prize will be immediately forfeited and an alternate Winner will be selected by the Sponsor in a random drawing from all remaining eligible entries. Upon selection of an alternate potential Winner, the provisions outlined above shall apply until such time as a potential Winner is declared a Winner.
Receipt by the Winner of the prize offered in this Contest is conditioned upon compliance with any and all federal, provincial, state and local laws and regulations.
Any violation of these official rules by the Winner (at the Sponsor’s sole discretion) will result in the Winner’s disqualification as the Winner of this Contest, and all privileges as the Winner will be immediately terminated.
The Sponsor reserves the right to cancel, suspend, withdraw or amend this Contest in any way, without prior notice or obligation, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of the Contest as contemplated by these Official Rules. Any attempt to deliberately undermine the legitimate operation of this Contest is a violation of criminal and civil law and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
All entrants are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor, including without limitation, government issued photo identification): (i) for the purposes of verifying an entrants eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry entered for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, n its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Official Rules. Failure by the entrant to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification in the sole and absolute discretion of the Sponsor.
Any attempt or suspected attempt to use robotic, automatic, programmed, or otherwise, illicit means to enter the Contest, or any other methods not authorized by these Official Rules, shall be deemed as tampering and will disqualify the entrant from entering, participating, winning prizes, and preclude the entrant from participating in future contests and promotions, at the sole and absolute discretion of the Sponsor. Entries that are late, lost, stolen, illegible, contain false information, are damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions of these Official Rules will be deemed void.
By entering this Contest, the entrant expressly releases, discharges, and holds harmless the Released Parties from any and all liability and damage which could arise out of or in any way related to the Contest and from the awarding, receipt, possession and/or misuse of the prize, including but not limited to any failure of the website during the Contest; for a technical malfunction or other problem relating to the telephone network or lines, computer online systems, serves, access providers, computer equipment or software; for the failure of any Entry to be received by the Sponsor; (iv) technical problems or traffic congestion on the Internet or website; or any combination of the above.
- Intellectual Property
All intellectual property, including but not limited to trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are owned by the Sponsor. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of the Sponsor is strictly prohibited.
This Contest is subject to all applicable federal, provincial, state and local laws and regulations.
By entering this Contest, the entrant agrees that the Sponsor, its agents, affiliates, subsidiaries and/or representatives may collect, store and use the personal information the entrant submitted in this Contest for the purpose of administering this Contest. Furthermore, the entrant expressly acknowledges that the Sponsor is in the business of performing statistical and other analysis on the personal information it collects (including but not limited to usage data, device data, referral data and question and response data and information) in order to measure user behaviour and trends, to understand how people use the Sponsor’s services, and to monitor, troubleshoot and improve the Sponsor’s services, including evaluating and devising new features. The entrant expressly consents that the Sponsor, its agents, affiliates, subsidiaries and/or representatives may collect, store and use the personal information the entrant submitted in this Contest for the Sponsor’s internal purposes designed to keep the Sponsor’s services secure and operations, such as for troubleshooting and testing purposes, and for service improvement, marketing, research and development purposes.
All of the information that the entrant provides will be treated as confidential and will only be used for the abovementioned purposes. The Sponsor, its agents, affiliates, subsidiaries and/or representatives will not sell, share or otherwise disclose personal information of entrants with third parties including Facebook, other than to third parties lawfully engaged by the Sponsor, its agents, affiliates, subsidiaries and/or representatives to fulfil the abovementioned purposes or as permitted or required by law.
Where the entrant opts-in online, the entrant expressly consents to the Sponsor, its agents, affiliates, subsidiaries and/or representatives use of the entrant’s personal information to be contract to (i) promote draws, interactive features and contests similar to the Contest; and (ii) be notified about programs, special events and related products and services of the Sponsor. The entrant may at any time elect to opt-out without revoking the entrant’s participation in the Contest or impairing the entrant’s chances of winning.
This Contest is governed by the laws of Canada and the Province of British Columbia, without respect to conflict of law doctrines. As a condition of participating in this Contest, the entrant agrees that any and all disputes that cannot be resolved in the first instance between the parties, and causes of actions arising out of or in any way connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Vancouver, British Columbia having jurisdiction. Further, in any such dispute, under no circumstances shall the entrant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other that the entrant’s actual out-of-pocket expenses (i.e. costs associated with entering this Contest). The entrant further waives all rights and remedies to have damages multiplied or increased.

In the event any entrant suspects that a technical error has occurred, believes their entry was not properly submitted, or has questions or complaints about this Contest or its administration, the entrant must contract the Sponsor at email@example.com and not any other third party who have not sponsored, endorsed or administered, or are associated with this Contest, including but not limited to Consumer Technology Association (CTA), Google LLC, Facebook Inc., Twitter Inc, Snap Inc, and any and all of its subsidiaries and affiliates.
